Question:
What common mistakes do people make in their premises liability cases?
Answer:
In Wyoming, common mistakes that people make in a premises liability case are the kinds of mistakes people make all the time. First of all, they talk to the insurance company for the other side. For instance, if somebody falls in a grocery store and is seriously injured, the risk manager from the grocery store contacts the individual, takes a statement and tries to put questions in there that show that the individual was not really hurt that bad or, if they were hurt that bad, it was their fault anyway. They’ll try and plant that seed in the discussion. There’s nothing to be gained in talking to the insurance company for a grocery store, for example, in regard to an injury. There’s nothing to be gained in that regard. People make that common mistake all the time.
The other thing is people don’t go to the doctor soon enough and determine the extent of the injuries. They get up and they say they’re embarrassed, or whatever, after they’ve fallen down or somehow gotten injured, and they jump up and go about their lives as best they can, not recognizing the full ramifications of their injury. Seek medical care – that’s very important in these cases – and seek medical care early on to determine the extent of your injuries.
